Terms of Service

These Terms of Service (“Terms”) govern use of the online art catalog and project tools (the “Service”) operated by General Public LLC (“General Public,” “we,” “us”). By creating an account, applying for trade access, or using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service; business use

The Service is a business tool for browsing our art catalog, building and sharing projects, and requesting quotes. You must be at least 18 and using the Service for business purposes. If you use the Service on behalf of a company, you represent that you can bind that company, and “you” includes it.

2. Accounts

You are responsible for your account, for keeping your sign-in method secure, and for activity under your account. Credentials and account access may not be shared outside your organization. Notify us promptly of any unauthorized use.

3. Trade and wholesale access

Trade and wholesale tiers are granted at our discretion following application review, and may be modified, suspended, or revoked at our discretion, including for inactivity, misuse, or misrepresentation in an application. Information presented to trade and wholesale members is provided for your business use with your clients and may not be republished publicly.

4. Our content and license to you

The Service and its contents — artwork images, product data, text, and software — are owned by General Public or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Service and to use catalog content within the Service’s features — including sharing projects, share links, exports, and PDFs with your own clients in the ordinary course of your business. You may not otherwise copy, scrape, harvest, bulk-download, resell, or publicly republish catalog content, or use it to train machine-learning models. General Public, Art Patron, Visual Contrast, Synograph™, and associated marks are trademarks of General Public LLC or its licensors; Simply Framed is a mark of Simply Framed, Inc. No trademark license is granted.

5. Your content

You retain your rights in content you submit (project names, notes, comments, application information). You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit that content as needed to operate and improve the Service. You are responsible for your content and represent that it does not violate law or third-party rights.

6. Acceptable use

You agree not to: misuse or interfere with the Service; probe, scrape, or access it by automated means (except public search engines honoring robots directives); attempt to access accounts, data, or administrative areas not intended for you; reverse engineer the Service; upload malicious code; or use the Service to violate law.

7. Quotes and orders

The catalog and projects are informational and do not constitute offers. Quotes, pricing, orders, invoicing, and fulfillment are handled through separate communications and agreements, which govern those transactions.

8. Third-party services

Sign-in is provided via Google and Microsoft; their terms govern your use of their services. Framing services are provided with Simply Framed, Inc., a separate company.

9. Termination

You may stop using the Service at any time and may request account deletion. We may suspend or terminate access at any time, with or without notice, for violation of these Terms or to protect the Service. Sections 4–13 survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Artwork colors, dimensions, and availability shown in the catalog are approximations and subject to confirmation at quoting.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERAL PUBLIC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM USE OF THE SERVICE. OUR AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You will indemnify General Public against claims arising from your content, your use of the Service in violation of these Terms, or your dealings with your own clients.

13. Governing law; disputes

These Terms are governed by California law. Disputes will be resolved in the state or federal courts located in Santa Barbara County, California, and you consent to their jurisdiction.

14. Changes

We may update these Terms; material changes will be posted on this page with an updated effective date, and continued use constitutes acceptance.
